TERMS AND CONDITIONS - Shipping
Payment Terms: Net 30 days from date of invoice, unless otherwise specified in CPI’s quote. Any invoice not paid within terms is subject to 1.5% monthly interest charge.
All shipments are F.O.B. Elmhurst, Illinois. Freight is not included, unless otherwise noted on our quote.
Fuel surcharges apply on all orders, unless otherwise noted on our quote.
All product packaging will be based on CPI direction and standards, unless otherwise agreed to in writing by CPI.
Quoted prices are valid on orders placed and released within 30 days of date quoted and are predicated on receiving all quoted items and quantities on that order.
If a Waiver of Lien is required, send your completed form, which will be released after our bank confirms customer payment has cleared (approximately a two-week process).
Galvanized product applications can only be accepted for Non-Cosmetic sensitive (i.e., surface finish condition) requirements. All galvanized products meet ASTM A123 (AASHTO M-111) standards. Galvanized products may not be rejected for general rough surface condition, dross protrusion (unless very heavy), dull gray coating or mottled appearance per ASTM A123 specifications.
Orders for fabricated, modified or special parts, including special finishes or powder coating, cannot be changed or canceled.
Returned stocked products must be deemed acceptable by CPI prior to issuance of credit and are subject to a restocking charge. CPI approval and RMA number are required prior to returning shipment.
Damage to freight must be fully noted on the delivery receipt in the presence of the driver. Photograph damage, if possible. Send copies of both to CPI. Concealed damage must be photographed and reported to CPI no later than one working day after receipt. CPI suggests that entire shipment be fully inspected, while the driver is present, if damage is suspected since, typically, carriers will only cover one-third of the cost of the product for concealed damage. If you’re questioning whether to reject shipment, contact CPI immediately. CPI is not responsible for freight claims on collect or 3rd party shipments.
Any claim of non-conforming material must be delivered to CPI within 10 days of date of shipment of order.

LIMITED WARRANTY
CPI’s Warranty as stated below is the sole and exclusive warranty for CPI’s products and is in lieu of all other express and implied warranties, including but not limited to all implied warranties of merchantability and fitness for a particular purpose.
CPI warrants to CPI’s customer that CPI products provided will be free from defects in workmanship.
CPI’s warranty is limited to 90 days from the date of shipment.
CPI’s warranty is limited to the repair or replacement of the product at CPI’s facility. Customer’s labor or other costs incurred in troubleshooting, repair, removal installation, service or handling of CPI products is not covered. Transportation to and from CPI’s facility shall be at customer’s expense, unless the CPI product is defective and covered by CPI’s limited warranty. CPI shall not be liable for any loss, cost, damage or expense of any kind, including but not limited to incidental, consequential, exemplary, special or punitive damages, nor for loss of profits arising out of the use of or the inability to use the CPI product. Before using the CPI product, customer shall determine the suitability of the product for its intended use, and assumes all risk and liability whatsoever in connection therewith. In no event will CPI be liable for any amount greater than the purchase price of a defective product.
CPI’s warranty shall be void and of no effect in the event that: (a) the CPI product has been used outside its design capacities: (b) the CPI product has been subjected to misuse, neglect, accident, improper or corrosive environments; (c) unauthorized modifications are made to the CPI product.
CPI’s warranty for powder-coated material is subject to powder source and actual destination of finished product. Severe weather conditions, road and/or saltwater void CPI’s warranty.
If customer orders a mix of aluminum and galvanized steel products for joined application, all CPI warranties are null and void.
All aluminum pole requirements for threading will have 15-16 NPT threads, enabling a secure fit with CPI aluminum cast bases. All aluminum square bases will meet or exceed 1985 AASHTO breakaway requirements. When threading aluminum poles into aluminum bases, 2-3 threads of the pole must be exposed and not connected with the base. If this requirement is not followed, CPI’s warranty is null and void.

PLEASE NOTE: CPI’s Responsibility for this shipment has ceased upon loading at our facility. LOST OR DAMAGED GOODS ARE THE CARRIER’S RESPONSIBILITY.
CHECK YOUR SHIPMENT CAREFULLY WHEN DELIVERED TO SEE THAT IT IS IN GOOD ORDER AND RECEIVED COMPLETE. When packages check short or are in bad condition, have the Carrier’s agent make a notation of this fact, IN DETAIL, on the Delivery Receipt and require that he/she sign it. Upon arrival of freight, well before releasing the Carrier’s agent, do the following:
• Check labels to ensure the shipment is yours• Check for shortages• Count handling units and compare to Delivery Receipt and Packing Slip• Take pictures, if possible, if you note any damage of any kind to packaging or product (if exposed)
CONCEALED LOSS OR DAMAGE DISCOVERED AFTER DELIVERY of shipment must be reported to the delivering Carrier & CPI upon discovery, and in any event within 5 days after receipt. You are required, by the Carrier, to hold the goods, containers, and packing materials in exact condition as found for inspection by the Carriers. An inspector for the Carrier should call within 5 days. If no information is received from the Carrier in that time frame, contact them again in order to secure their inspection report which will be used to support your claim. Require the Carrier to give you a copy of the inspection report. The Carrier has the right to inspect any Damage, whether concealed or not, up until the claim is settled, so the package/packages in question must be maintained in a secure/safe area until claim disposition has been made.
FAILURE TO COMPLY WITH ANY OF THE FOREGOING REGULATIONS is regarded as an indication that your shipment has arrived in satisfactory condition and is complete as shown on our Packing Slip.
MAKE YOUR CLAIM PROMPTLY. Most Carriers will not consider a claim unless presented within 9 months after receipt of shipment.
IMPORTANT: Do not deduct the amount of loss or damage from CPI’s Invoice while awaiting adjustment from a claim, as we cannot guarantee safe delivery for actions beyond our control.
PLEASE DO NOT return goods to CPI or instruct Carriers to do so without first securing written authorization, shipping instructions & a RMA No. from CPI as we cannot accept returns without this.
